In the field of Evidence Law the relation between truth and law has been a somewhat non- debated topic in the past years. It is a given that such a connection exists and, it is understood as the notion of the ascertainment of the truth of disputed questions of fact through legal evidence. The thesis that I have reconstructed in this paper has been presented by Prof. Jordi Ferrer who grounds the connection between truth and law in the role (...) of the legal system as a tool for guiding the behavior of the governed. I call this thesis the theory of the structural clause of truth. In this paper I shall present a possible reconstruction of this theory, I shall raise two objections against it and I shall present five possible interpretations of the relation between truth and law. I have not tried to fix, polish-up, or clarify Nietzsche’s unpublished writings. Some of the translator have really refined Nietzsche’s ideas and positions. I have not “fixed” Nietzsche. I have not dropped or added words or changed the wording to make Nietzsche’s position clearer or stronger (others have done enough damage). Learn German and read the texts in German – my best recommendation and advice to you the reader. There are groups on the internet that work on all the details of translating Nietzsche’s remarks. There are many nuances and shades of the meaning in attempting to translate anyone’s language. Some words I could not translate from German and French; and I left those few words in German, but more words in French. I think most of the French texts are quotes that Nietzsche wrote down from French authors that he was reading at the time he wrote these notes. Reader beware. There are many historical and philosophical allusions as in all of Nietzsche’s philosophical writings and these notebooks are similar. Remember these are “notebooks” and include lots of notes or jottings -- and these are neither fragments nor polished drafts for publication. Nietzsche may have written these notebooks from back to front and re-used various notebooks at a later time. In the German text there are missing punctuations marks, missing quotation marks, missing words, abbreviation of words, miss numbered section, working table of contents for project books he wanted to publish, projects outlined, quotes without quote marks. Hegel, but the actual authorship is disputed. No date is given. Franz Rosenzweig made up the title as it is known today. He published the text in 1917. At that time, F. Rosenzweig thought F.W.J. Schelling was the author. No one has read this book for errors. As always, any errors, mistakes or oversights etc. are mine alone. Given a couple more years, I could improve this book. This is a philosophical translation and not a philological translation. Martin Luther who did the famous early translation of the Bible into German wrote in a letter, “If anyone does not like my translation, they can ignore it… (September 15, 1530)”. There are no ‘correct’ translations. Some are just better than other translations. -/- The Oldest Systematic Program of German Idealism. The German title is: Das Älteste Systemprogramm Des Deutschen Idealismus. This title was made up by Franz Rosenzweig in 1917, when he first published the manuscript. He found the manuscript in the Royal Library in Berlin in 1913. The manuscript suggested date is around 1796 and was done by handwriting research. However, the manuscript is not dated. The Prussian State Library auctioned in March 1913 from the auction of the house Liepmannssohn in Berlin a single sheet on the front and back with Hegel's cursive handwriting. The manuscript was lost during WWII. But Dieter Henrich found it again in 1979 in the “Biblioteka Jagiellonska” in Krakow (Poland), where it is today. Address: Jagiellonian Library, Jagiellonian University, al. Mickiewicza 22, 30-059 Cracow, Poland. Later research suggests that manuscript had come from the estate of Hegel’s student Friedrich Christoph Förster (1791-1868). He was one of the editors of Hegel’s posthumous works and most likely had access to a number of Hegel’s manuscripts. This text actually being one of them. Hegel traveled around Bohemia with Marie and Friedrich Christoph Förster around the year 1820-21 (see Klaus Vieweg). -/- Philosophical mystery -- who is the author or authors of this text? -/- Take a plunge into the deep and cold waters. Maybe a quagmire or quandary, but decidedly interesting. This project is to contextualize an old handwritten manuscript which is about 225 years old. The actual author is a mystery. I offer my own assessment. You can make your own assessments. The mystery has continued to unfold since 1917. There is plenty to read. Otherwise, think about the authorship and read more of the German philosophers and authors from this period and enjoy the depth of thinking and philosophizing. On one hand, there is just the sheer fun in the puzzle of the authorship questions; and on the other hand, these are the alluring thoughts that lead to the nascent stage of German Idealism and our intellectual heritage. There is no end to the accolades for this group of philosophers. A heritage that we still hear in in our attempts to move forward into our future. -/- Do your own astute exegesis (ἐξήγησις) as all paths are still open. Let your thought take to the wings of what is called thinking with this text. Critical encounters (Auseinandersetzung, or a Gegenüberstellung) with at least: Friedrich Hölderlin (1770-1843) Friedrich Wilhelm Joseph Schelling (1775-1854), and Georg Wilhelm Friedrich Hegel (1770-1831) --- starts here! German Idealism. We are not going to study this situation endlessly, instead we make some broad strokes and provide you a general context. You are allowed to read between the lines too. Goal: to understand the overall affinity and differences between the intellectuals of this period in German history; and to come to grips with this demanding text within its large scholarly context in the last 100 years. English translation of Kant's Beantwortung der Frage: Was ist Aufklärung? (Königsberg in Prussia, 30 September 1784).

Speech Acts, Criteria and Intentions What makes a speech act a speech act? Which are its necessary and sufficient conditions? I claim in this paper that we cannot find an answer to those questions in Austin's doctrine of the infelicities, since some infelicities take place in fully committing speech acts, whereas others prevent the utterance from being considered as a speech act at all. With this qualification in mind, I argue against the idea that intentions—considered as mental states accomplishing a (...) causal role in the performance of the act—should be considered among the necessary conditions of speech acts. I would thus like to deny a merely ‘symptomatic’ account of intentions, according to which we could never make anything but fallible hypotheses about the effective occurrence of any speech act. I propose an alternative ‘criterial’ account of the role of intentions in speech acts theory, and analyse Austin's and Searle's approaches in the light of this Wittgensteinian concept. Whether we consider, with Austin, that speech acts ‘imply’ mental states or, with Searle, that they ‘express’ them, we could only make sense of this idea if we considered utterances as criteria for intentions, and not as alleged behavioural effects of hidden mental causes. El presente artículo tiene por objetivo plantear la pregunta por la técnica económica en el sentido heideggeriano del preguntar. Con “sentido heideggeriano” nos referimos al modo en el que Heidegger plantea la pregunta por la técnica a partir de la perturbación que provoca la técnica moderna. En otras palabras, nos preguntamos por “la” técnica económica inspirados por las consecuencias – pasadas, actuales y potenciales – de la técnica económica moderna: la economía de mercado. El trabajo procederá de la siguiente manera. (...) En primer lugar, planteamos la pregunta por la técnica económica explicando los motivos que nos llevan a ella y la inspiración heideggeriana de esta pregunta. En particular, apuntamos al fenómeno de la crisis económica en su sentido contemporáneo. En segundo lugar, buscaremos mostrar que, tal como hizo Heidegger con la técnica, no es posible hablar de “la” economía, sino que será necesario distinguir entre una economía antigua y una economía moderna. En tercer lugar, recurriremos al estudio histórico-antropológico de Karl Polanyi para describir la distinción entre ambos modos de concebir lo económico. En cuarto lugar, a partir de la descripción anterior mostraremos que la economía de mercado no es un mero instrumento para la producción de condiciones materiales, pues está caracterizada por una esencia provocante. Finalmente, concluiremos en torno a las consecuencias y posibilidades de esta descripción filosófica de la economía de mercado. Globally, languages are disappearing at an unprecedented rate. To establish successful strategic options on how to protect the language's survival, members of linguistic communities must be knowledgeable of the reasons for language extinction or endangerment. This paper discusses how the number of people who speak Pangasinan, which is the eighth most common language in the Philippines, is decreasing over time and how this is affecting the language. It gives an outline of the Pangasinan language's current vitality and covers the Philippines' (...) language policy history. It also considers a situation in which globalization may provide unexpected chances for language revitalization. This study seeks to serve as a springboard for future research and aids teachers and other relevant educational personnel in identifying, comprehending, assessing, and implementing appropriate language-endangerment remedies. These are the 22 notebooks of Nietzsche’s last notebooks from 1886-1889. Nietzsche stopped writing entirely around 6th of January 1889. There are 1785 notes translated here. This group of notes translated in this book is not complete for the year 1886. There are at least two other notebooks that were done in the year 1886. However, Nietzsche wrote in his notebooks sometime from back to front and currently the notebooks are only in a general chronological order. Refer to the German (...) Purpose: The purpose of this research is to analyze the characteristics of entrepreneurship in influential people in Romania, given that entrepreneurship is what guarantees the success of any business. -/- Methodology: There are five indicators that show that a certain person has the entrepreneurial spirit: passion, optimism, continuous improvement, take calculated risks and achieve their goals. -/- Results: Entrepreneurship is not learned, but is formed over time and is formed from within the person. So entrepreneurship becomes part of what people (...) really are. Entrepreneurship develops in people, when they feel motivated, empowered, take risks, show passion and are willing to achieve great goals. In other words, to exceed their own limits. Also, the entrepreneurial spirit is always looking for change, because here it is a mentality that is constantly looking for innovation, in seeing the big picture, always looking for constructive feedback, always looking for new opportunities and in to always have a critical spirit. In addition, due to the entrepreneurial spirit that a person manifests, their employees will embrace this entrepreneurial mentality and will come up with new ideas, solutions and opportunities to problems, and this makes organizations grow and develop. In spite of being ubiquitous in life sciences, the concept of information is harshly criticized. Uses of the concept other than those derived from Shannon's theory are denounced as pernicious metaphors. We perform a computational experiment to explore whether Shannon's information is adequate to describe the uses of said concept in commonplace scientific practice. Our results show that semantic sequences do not have unique complexity values different from the value of meaningless sequences. This result suggests that quantitative theoretical frameworks do (...) not account fully for the complex phenomenon that the term “information” refers to. We propose a restructuring of the concept into two related, but independent notions, and conclude that a complete theory of biological information must account completely not only for both notions, but also for the relationship between them. This paper investigates the differences between ancient Greek and modern ethical naturalism, through the account of the whole classical tradition provided by Cicero in De finibus bonorum et malorum. Ever since Hume’s remarks on the topic, it is usually held that derivations of normative claims from factual claims require some kind of proper justification. It ́s a the presence of such justifications in the Epicurean, Stoic, and Academic-Peripatetic ethical theories (as portrayed in De finibus), and, after a negative conclusion, I (...) argue that we should conceive of this issue within a social-historical perspective: The radical difference between ancient and modern naturalistic ethics is due (in Weber’s terms) to the rationalization processes that generated the modern outlook on nature. In Ancient Greece, the figure of the hero was identified as a demigod, possessed of altruistic and virtuous deeds. When Pierre de Coubertin reinstated the Olympic Games, the athlete was personified as a modern hero. Its antithesis, the anti-hero, has more virtue that defects, no evil but he does not care on the means to achieve his goals. In the eyes of everyone involved in sports competition, these characters captivate and at the same time, create conflicts of ethics and aesthetics. (...) The purpose of this paper is to perform an ethical reflection linked to principles that contribute for the human growth and accomplishment, as well as the aesthetic on the perception of the sensitive, reverberated by sensations and feelings emerging from athletes. Connecting the ethic with the aesthetic spheres, we could have in the sports a phenomenon walking toward a common point between moral and aesthetic, between the good and the beauty. (shrink)

The European project European and Latin American Systems of Ethics Regulation of Biomedical Research Project (EULABOR) has carried out the first comparative analysis of ethics regulation systems for biomedical research in seven countries in Europe and Latin America, evaluating their roles in the protection of human subjects. We developed a conceptual and methodological framework defining ‘ethics regulation system for biomedical research’ as a set of actors, institutions, codes and laws involved in overseeing the ethics of biomedical research on humans. This (...) framework allowed us to develop comprehensive national reports by conducting semi-structured interviews to key informants. These reports were summarised and analysed in a comparative analysis. The study showed that the regulatory framework for clinical research in these countries differ in scope. It showed that despite the different political contexts, actors involved and motivations for creating the regulation, in most of the studied countries it was the government who took the lead in setting up the system. The study also showed that Europe and Latin America are similar regarding national bodies and research ethics committees, but the Brazilian system has strong and noteworthy specificities. (shrink)

Es generalmente aceptado que la relación entre la crisis económica actualmente en desarrollo y la pandemia de enfermedad por coronavirus es de tipo causal, esto es, se afirma que la pandemia ha causado la crisis. El objetivo de este trabajo es argumentar que este vı́nculo no cumple con los requisitos para ser definido como una relación de causalidad y se propondrá la noción de relación develadora para dar cuenta de la interacción entre ambos sucesos. El trabajo se desarrolla de la (...) siguiente manera: en primer lugar, se sitúa el problema dentro del campo de la filosofı́a de la economı́a. En segundo lugar, se desarrollan los argumentos para mostrar que la relación entre coronavirus y crisis no es de tipo causal. Hume presenta su teoría estética en el ensayo Sobre el criterio del gusto [On the Standard of Taste], en el que propone la existencia de un criterio [standard] capaz de zanjar discusiones de gusto. Ese criterio se basa en la existencia de ciertas formas y cualidades que complacen naturalmente a todo ser humano. Hume asevera que tal criterio corresponde a la opinión del crítico: un hombre que ha desplegado particularmente sus facultades cognoscitivas, lo cual le permite percibir esas finas cualidades (...) que suscitan naturalmente el placer de lo bello en el ser humano. Con respecto a en qué consisten esas formas y cualidades universalmente placenteras, Hume guarda silencio. Pretendo mostrar cómo la teoría de la emoción en la música desarrollada por Leonard Meyer en su texto Emoción y significado en la música (Emotion and Meaning in Music) puede aportar inmensidades en ese aspecto. To help clarify the concept of «teaching practice», this article analyzes a repository of professional skills of the teacher. It then examines how two groups of teacher educators attempting to use this repository to evaluate two teaching sessions (one secondary and one primary). Analyses revealed the difficulty in assessing a session from elements determined a priori from a list of skills. The evaluation of a teaching session seems to require the inclusion of its organic whole. Il examine ensuite la manière dont deux groupes de formateurs d’enseignants tentent d’utiliser ce référentiel pour évaluer deux séances d’enseignement (une dans le secondaire et une dans le primaire). Les analyses révèlent la difficulté à évaluer une séance à partir d’éléments déterminés a priori dans une liste de compétences. This study applies Arne Naess’ ecosophy as a tool for possible progressive research material concerning the National Greening Program (NGP) of the Department of Environment and Natural Resources (DENR). This study aims to conduct a phenomenological analysis of tree farming advantages, driven by a philosophical approach and practical strategy integrated through the principle of deep ecology. The philosophy of deep ecology presupposes ethics and the interrelatedness of human beings to nature that generally can be experienced anywhere. This study aims to (...) assess the core motives, plans, objectives, strategic implications, initiatives, provisions, and the probable outcome of the said government program. To realize this, this research enunciates a possible parallel study between Naess's deep ecology and the DENR's goal. Since this study is concerned with the current situation of human beings, it delves into the context of the phenomenological research approach. It provides different perspectives on the other government officials who were once the program's authors and implementers. As this research goes on, the findings have various outlooks on applying deep ecology to facilitate the government's NGP. The crucial part of making this program absolute must be the participation of every individual in such advocacy as a sole environmental bailiff. However, the challenge never ceases to interrupt the goodwill of human beings. On the other hand, man's passion never fails to contribute to sustainable ecological preservation, biodiversity, reparation, and community commitment. (shrink)

El plagio ha sido objeto de investigaciones desde hace algunos años; sin embargo, ha sido estudiado principalmente en el alumnado de diferentes niveles educativos, aun cuando es una práctica que se manifiesta también en la investigación científica. Por ello, este artículo parte de responder: ¿Cuál es la prevalencia del plagio entre investigadores? ¿Cuáles son las principales causas asociadas a su comisión? ¿Qué estrategias se emplean para prevenirlo? Se realizó una revisión sistemática de literatura. Un total de 25 documentos fueron evaluados, (...) analizados y sintetizados. Los resultados señalan que la estimación de la prevalencia del plagio es de 4.3% a nivel internacional, porcentaje por debajo de la práctica real debido al sesgo de respuesta: algunos investigadores podrían no estar reportando la comisión de plagio en su práctica investigativa, aun cuando participen de forma anónima en las investigaciones. La principal razón asociada al plagio es la falta de tiempo, relacionada con el trabajo excesivo y con la presión para lograr una promoción. Las estrategias de prevención se agrupan en tres: implementación de capacitaciones, creación o modificación de políticas y documentos. La revisión, a pesar de centrarse originalmente en el plagio, añade información sobre otras prácticas investigativas no éticas. Se concluye que el plagio, a pesar de su aparente baja prevalencia, es un fenómeno grave presente en la investigación científica, que requiere una definición clara y completa con miras a ser aceptada de forma internacional, además de que necesita ser estudiado en mayor medida y con diferentes metodologías. Se sugieren nuevas líneas de investigación y se invita a atender las estrategias de prevención recabadas. (shrink)

The Acharya Nagarjuna (2-3d century AD) is perhaps the greatest single Indian philosopher; he is considered the greatest Buddhist thinker after the Buddha himself. Nagarjuna although less famous than (...) the other two philosopher, his audacious and unique eastern way of thinking may provide some fundamental solutions to Heidegger's and Nietzsche's stickler dilemmas; and their morass and entanglement in their western philosophical predicaments and knots. A partir de esto, comienza una critica a los paradigmas innatistas, neurocentristas y constructivistas de la cognición matemática. El marco de la crítica a las ideas contenidistas del significado en las teorías innatas y constructivistas se fundamenta den la idea del significado como un bucle dinámico que emerge de las interdependencias cerebro-mente-entorno irreductible a un nivel sobre otros. Aquí el (...) cuerpo, las metáforas conceptuales y los entornos educativos ecológicos como STEAM proporcionan instancias para un significado corpóreo, situado, anti-representacionalista y enmarcado en el ciclo de percepción-acción. El siguiente trabajo aborda el tema de la libertad en el Héroe cubano no desde el punto de vista histórico, sino desde lo filosófico. A partir de esto se desarrollan las dimensiones de la libertad que se expresan en el ideario martiano: ontología, conocimiento, ética y filosófica. Todo este esquema de pensamiento es conformado para una finalidad, la libertad del hombre; (...) y sobre todo, para emancipar al Ser latinoamericano. El presente capítulo tiene la finalidad de describir las diferencias entre un tiempo objetivo de aprendizaje y la temporalidad de la experiencia de aprendizaje. Para esto, cuestiona el paradigma actual de la cognición orientada al procesamiento de la información, donde el tiempo de aprendizaje de la interacción en el aula está susbsumido a un a priori que anticipa el devenir espontáneo de la interacción. En respuesta a lo anterior, proponemos más bien el paradigma contemporáneo de la ecología cognitiva que refuta (...) la idea representacionalista de la cognición y se abre a la dimensión de lo posible que emerge de las interdependencia cerebro-mente-entorno. Se lleva a cabo un planteamiento del estatus de la naturaleza en el ordenamiento jurídico como sujeto y objeto de derechos. Para lograr este objetivo, los autores se valen de una metodología inductiva a partir de un análisis descriptivo desde la doctrina, jurisprudencia y normas primarias. Con ello, se busca, en primer lugar, responder a la cuestión de si es posible o no que un ordenamiento jurídico contemple derechos de la naturaleza; en segundo lugar, se pretende evidenciar cómo el reconocimiento (...) de derechos sobre la naturaleza por parte de la jurisprudencia en Colombia cuenta con presupuestos comunes pese a que aún no se contemplan reglas claras sobre la asignación de derechos a la naturaleza. Al final, se realiza un llamado de atención para comprender esta figura más como un instrumento que el Estado debe utilizar a favor de la naturaleza, que como un decálogo de derechos. (shrink)
