In the field of Evidence Law the relation between truth and law has been a somewhat non- debated topic in the past years. It is a given that such a connection exists and, it is understood as the notion of the ascertainment of the truth of disputed questions of fact through legal evidence. The thesis that I have reconstructed in this paper has been presented by Prof. Jordi Ferrer who grounds the connection between truth and law in the role (...) of the legal system as a tool for guiding the behavior of the governed. I call this thesis the theory of the structural clause of truth. In this paper I shall present a possible reconstruction of this theory, I shall raise two objections against it and I shall present five possible interpretations of the relation between truth and law. Speech Acts, Criteria and Intentions What makes a speech act a speech act? Which are its necessary and sufficient conditions? I claim in this paper that we cannot find an answer to those questions in Austin's doctrine of the infelicities, since some infelicities take place in fully committing speech acts, whereas others prevent the utterance from being considered as a speech act at all. With this qualification in mind, I argue against the idea that intentions—considered as mental states accomplishing a (...) causal role in the performance of the act—should be considered among the necessary conditions of speech acts. I would thus like to deny a merely ‘symptomatic’ account of intentions, according to which we could never make anything but fallible hypotheses about the effective occurrence of any speech act. I propose an alternative ‘criterial’ account of the role of intentions in speech acts theory, and analyse Austin's and Searle's approaches in the light of this Wittgensteinian concept. Whether we consider, with Austin, that speech acts ‘imply’ mental states or, with Searle, that they ‘express’ them, we could only make sense of this idea if we considered utterances as criteria for intentions, and not as alleged behavioural effects of hidden mental causes. Its antithesis, the anti-hero, has more virtue that defects, no evil but he does not care on the means to achieve his goals. In the eyes of everyone involved in sports competition, these characters captivate and at the same time, create conflicts of ethics and aesthetics. (...) The purpose of this paper is to perform an ethical reflection linked to principles that contribute for the human growth and accomplishment, as well as the aesthetic on the perception of the sensitive, reverberated by sensations and feelings emerging from athletes. Connecting the ethic with the aesthetic spheres, we could have in the sports a phenomenon walking toward a common point between moral and aesthetic, between the good and the beauty. (shrink)

El presente artículo tiene por objetivo plantear la pregunta por la técnica económica en el sentido heideggeriano del preguntar. Con “sentido heideggeriano” nos referimos al modo en el que Heidegger plantea la pregunta por la técnica a partir de la perturbación que provoca la técnica moderna. En otras palabras, nos preguntamos por “la” técnica económica inspirados por las consecuencias – pasadas, actuales y potenciales – de la técnica económica moderna: la economía de mercado. El trabajo procederá de la siguiente manera. (...) En primer lugar, planteamos la pregunta por la técnica económica explicando los motivos que nos llevan a ella y la inspiración heideggeriana de esta pregunta. En particular, apuntamos al fenómeno de la crisis económica en su sentido contemporáneo. En segundo lugar, buscaremos mostrar que, tal como hizo Heidegger con la técnica, no es posible hablar de “la” economía, sino que será necesario distinguir entre una economía antigua y una economía moderna. En tercer lugar, recurriremos al estudio histórico-antropológico de Karl Polanyi para describir la distinción entre ambos modos de concebir lo económico. En cuarto lugar, a partir de la descripción anterior mostraremos que la economía de mercado no es un mero instrumento para la producción de condiciones materiales, pues está caracterizada por una esencia provocante. Finalmente, concluiremos en torno a las consecuencias y posibilidades de esta descripción filosófica de la economía de mercado. Ese criterio se basa en la existencia de ciertas formas y cualidades que complacen naturalmente a todo ser humano. Hume asevera que tal criterio corresponde a la opinión del crítico: un hombre que ha desplegado particularmente sus facultades cognoscitivas, lo cual le permite percibir esas finas cualidades (...) que suscitan naturalmente el placer de lo bello en el ser humano. Con respecto a en qué consisten esas formas y cualidades universalmente placenteras, Hume guarda silencio. Pretendo mostrar cómo la teoría de la emoción en la música desarrollada por Leonard Meyer en su texto Emoción y significado en la música (Emotion and Meaning in Music) puede aportar inmensidades en ese aspecto. The European project European and Latin American Systems of Ethics Regulation of Biomedical Research Project (EULABOR) has carried out the first comparative analysis of ethics regulation systems for biomedical research in seven countries in Europe and Latin America, evaluating their roles in the protection of human subjects. We developed a conceptual and methodological framework defining ‘ethics regulation system for biomedical research’ as a set of actors, institutions, codes and laws involved in overseeing the ethics of biomedical research on humans. This (...) framework allowed us to develop comprehensive national reports by conducting semi-structured interviews to key informants. These reports were summarised and analysed in a comparative analysis. The study showed that the regulatory framework for clinical research in these countries differ in scope. It showed that despite the different political contexts, actors involved and motivations for creating the regulation, in most of the studied countries it was the government who took the lead in setting up the system. The study also showed that Europe and Latin America are similar regarding national bodies and research ethics committees, but the Brazilian system has strong and noteworthy specificities. (shrink)

This paper investigates the differences between ancient Greek and modern ethical naturalism, through the account of the whole classical tradition provided by Cicero in De finibus bonorum et malorum. Ever since Hume’s remarks on the topic, it is usually held that derivations of normative claims from factual claims require some kind of proper justification. It ́s a the presence of such justifications in the Epicurean, Stoic, and Academic-Peripatetic ethical theories (as portrayed in De finibus), and, after a negative conclusion, I (...) argue that we should conceive of this issue within a social-historical perspective: The radical difference between ancient and modern naturalistic ethics is due (in Weber’s terms) to the rationalization processes that generated the modern outlook on nature. Purpose: The purpose of this research is to analyze the characteristics of entrepreneurship in influential people in Romania, given that entrepreneurship is what guarantees the success of any business. -/- Methodology: There are five indicators that show that a certain person has the entrepreneurial spirit: passion, optimism, continuous improvement, take calculated risks and achieve their goals. -/- Results: Entrepreneurship is not learned, but is formed over time and is formed from within the person. Entrepreneurship develops in people, when they feel motivated, empowered, take risks, show passion and are willing to achieve great goals. In other words, to exceed their own limits. Also, the entrepreneurial spirit is always looking for change, because here it is a mentality that is constantly looking for innovation, in seeing the big picture, always looking for constructive feedback, always looking for new opportunities and in to always have a critical spirit. In addition, due to the entrepreneurial spirit that a person manifests, their employees will embrace this entrepreneurial mentality and will come up with new ideas, solutions and opportunities to problems, and this makes organizations grow and develop. Para esto, se consideran las hipótesis de movimiento centrı́peto orientado a la autoafección, y movimiento centrı́fugo aludido a la ruptura de la intercorpereidad. Ambos movimientos, hacen referencia a la sensación ambigua que el cuerpo vive en la pena asociados a la presencia y ausencia del otro que ya no está, ya que el dolor provee un estado de (...) desincronización temporal que vuelve simultáneos el presente-pasado y presente-futuro. In this paper I argue against what I label as "Lightweight interpretation of ontological disputes". This interpretation criteria sees ontological disputes as metalinguistic negotiations concerning the pursuing of practical objectives. I have developed an argument, called "That's not the issue", which shows that this interpretation criteria is inapplicable to most ontological disputes.

Citizen Satisfaction Index System (CSIS) was used to assess the delivery of support to education initiatives in the municipality of Banga, Aklan, Philippines. The samples were determined using multiple application of stratified random sampling approach. In accordance with the Philippine Statistical Authority's Data on Census Population and Housing for 2015, barangays having a bigger share of the population contributed more respondents to the 150 targeted participants. Following the inclusion criteria, the probability respondents were chosen using the Kish Grid. Pre-numbered questionnaires (...) were distributed, with odd numbers targeting male responders and even numbers targeting females. The following criteria were used to evaluate the respondents' assessments: awareness, availment of the program/service, satisfaction, and need for action. Furthermore, interviews were conducted to better understand and investigate the respondents' thoughts, behavior, and perspectives. The reasons for their reaction were also obtained. The data was provided in percentage as well as frequency distributions. The study inferred that awareness on alternative learning system and/or special education program should be improved since it is the only program that attained low rating for awareness. Most of the residents were not able to avail education programs because they have no household member who attends school. Majority of the respondents who availed the services were satisfied. However, scholarship and other assistance programs to students may be enhanced to improve service delivery. It is highly recommended by the citizens to improve accessibility to scholarship programs and other forms of financial assistance to students. (shrink)

In spite of being ubiquitous in life sciences, the concept of information is harshly criticized. Uses of the concept other than those derived from Shannon's theory are denounced as pernicious metaphors. We perform a computational experiment to explore whether Shannon's information is adequate to describe the uses of said concept in commonplace scientific practice. Our results show that semantic sequences do not have unique complexity values different from the value of meaningless sequences. This result suggests that quantitative theoretical frameworks do (...) not account fully for the complex phenomenon that the term “information” refers to. We propose a restructuring of the concept into two related, but independent notions, and conclude that a complete theory of biological information must account completely not only for both notions, but also for the relationship between them. Recent years have seen a heightened focus on the study of minimal forms of awareness during sleep to advance the study of consciousness and understand what makes a state conscious. This focus draws on an increased interest in anecdotical descriptions made by classic Indian philosophical traditions about unusual forms of awareness during sleep. For instance, in the so-called state of witnessing-sleep or luminosity sleep, one is said to reach a state that goes beyond ordinary dreaming and abide in a state (...) of just awareness, a state in which one is not aware of anything else other than one’s own awareness. Moreover, for these traditions, this state is taken to be the essence or background of consciousness. Reports on such a state opens the door to exciting new lines of research in the study of consciousness, such as inquiry into the so-called “objectless” awareness during sleep—states of awareness that lack an ordinary object of awareness. In this two-staged research project, we attempted to find the phenomenological blueprints of such forms of awareness during sleep in 18 participants by conducting phenomenological interviews, informed by a novel tool in qualitative research, the micro-phenomenological interview (MPI) method. Following a phenomenological analysis, we isolated a similar phase across 12 reported experiences labelled as ‘nothingness phase’ since it described what participants took to be an experience of ‘nothingness’. his common phase was characterised by minimal sense of self—a bodiless self, yet experienced as being ‘somewhere’—, the presence of non-modal sensations, relatively pleasant emotions, an absence of visual experience, wide and unfocused attention, and an awareness of the state as it unfolded. I think most of the French texts are quotes that Nietzsche wrote down from French authors that he was reading at the time he wrote these notes. Reader beware. There are many historical and philosophical allusions as in all of Nietzsche’s philosophical writings and these notebooks are similar. Remember these are “notebooks” and include lots of notes or jottings -- and these are neither fragments nor polished drafts for publication. Mathematical modeling offers a promising approach to improving mathematics education. This study aims to determine if the concept of metacognitive awareness in the learning process is associated with mathematical modeling. This study also considers the interaction effect of sex and academic year level on both variables. Focusing the study on preservice elementary teachers might address potential issues and targeted intervention in their preparation program concerning their ability to teach and guide young learners in modeling activities. The research sample includes 140 (...) preservice elementary teachers at Central Luzon State University, Philippines. Data collection used an adapted metacognitive awareness inventory and a validated researcher-made mathematical modeling competency test aligned with the K-12 mathematics curriculum in the Philippines. Results revealed that the preservice elementary teachers had a high metacognitive awareness and mathematical modeling competency, ranging from 22 to 31 out of 36 points. Besides, Factorial ANOVA indicates that academic year level positively affects both variables regardless of sex, and stepwise regression analysis unveiled that information management, declarative knowledge, and planning significantly predict 41.4% of the mathematical modeling competency variance. This suggests that developing metacognitive awareness supports preservice elementary teachers in performing modeling tasks that improve their competency level in mathematics. (shrink)

Globally, languages are disappearing at an unprecedented rate. To establish successful strategic options on how to protect the language's survival, members of linguistic communities must be knowledgeable of the reasons for language extinction or endangerment. This paper discusses how the number of people who speak Pangasinan, which is the eighth most common language in the Philippines, is decreasing over time and how this is affecting the language. It gives an outline of the Pangasinan language's current vitality and covers the Philippines' (...) language policy history. It also considers a situation in which globalization may provide unexpected chances for language revitalization. This study seeks to serve as a springboard for future research and aids teachers and other relevant educational personnel in identifying, comprehending, assessing, and implementing appropriate language-endangerment remedies. Through the Multi-Stage Random Probability Sampling technique, 150 respondents from barangays’ share in the municipal population were determined based on the Philippine Statistical Authority’s Data on Census Population and Housing for the 2015. The probability respondents were selected using the Kish Grid where female respondents were given even numbered questionnaires while male respondents were assigned odd numbers. The four (...) major core concepts namely awareness, availment, satisfaction and need for action were used in measuring the ratings presented in frequency and percentage distributions. Interview was also conducted to gather reasons for their ratings. The study inferred that majority of the respondents were highly aware of the community-based greening project. However, low awareness was attained on projects such as air pollution control program and waste-water management. A high percentage of respondents have availed the environmental management programs except for solid waste management. Overall, majority of the respondents were satisfied of the environmental management programs rendered by the local government unit and therefore needs less action. Hegel, but the actual authorship is disputed. No date is given. Franz Rosenzweig made up the title as it is known today. He published the text in 1917. At that time, F. Rosenzweig thought F.W.J. Schelling was the author. No one has read this book for errors. As always, any errors, mistakes or oversights etc. are mine alone. Given a couple more years, I could improve this book. This is a philosophical translation and not a philological translation. Martin Luther who did the famous early translation of the Bible into German wrote in a letter, “If anyone does not like my translation, they can ignore it… (September 15, 1530)”. There are no ‘correct’ translations. Some are just better than other translations. -/- The Oldest Systematic Program of German Idealism. The German title is: Das Älteste Systemprogramm Des Deutschen Idealismus. This title was made up by Franz Rosenzweig in 1917, when he first published the manuscript. He found the manuscript in the Royal Library in Berlin in 1913. The manuscript suggested date is around 1796 and was done by handwriting research. However, the manuscript is not dated. The Prussian State Library auctioned in March 1913 from the auction of the house Liepmannssohn in Berlin a single sheet on the front and back with Hegel's cursive handwriting. The manuscript was lost during WWII. But Dieter Henrich found it again in 1979 in the “Biblioteka Jagiellonska” in Krakow (Poland), where it is today. Address: Jagiellonian Library, Jagiellonian University, al. Mickiewicza 22, 30-059 Cracow, Poland. Later research suggests that manuscript had come from the estate of Hegel’s student Friedrich Christoph Förster (1791-1868). He was one of the editors of Hegel’s posthumous works and most likely had access to a number of Hegel’s manuscripts. This text actually being one of them. Hegel traveled around Bohemia with Marie and Friedrich Christoph Förster around the year 1820-21 (see Klaus Vieweg). -/- Philosophical mystery -- who is the author or authors of this text? -/- Take a plunge into the deep and cold waters. Maybe a quagmire or quandary, but decidedly interesting. This project is to contextualize an old handwritten manuscript which is about 225 years old. The actual author is a mystery. I offer my own assessment. You can make your own assessments. The mystery has continued to unfold since 1917. There is plenty to read. Otherwise, think about the authorship and read more of the German philosophers and authors from this period and enjoy the depth of thinking and philosophizing. On one hand, there is just the sheer fun in the puzzle of the authorship questions; and on the other hand, these are the alluring thoughts that lead to the nascent stage of German Idealism and our intellectual heritage. There is no end to the accolades for this group of philosophers. A heritage that we still hear in in our attempts to move forward into our future. -/- Do your own astute exegesis (ἐξήγησις) as all paths are still open. Let your thought take to the wings of what is called thinking with this text. Critical encounters (Auseinandersetzung, or a Gegenüberstellung) with at least: Friedrich Hölderlin (1770-1843) Friedrich Wilhelm Joseph Schelling (1775-1854), and Georg Wilhelm Friedrich Hegel (1770-1831) --- starts here! Pets are truly great companions. Some individuals feel that owning a pet can help them prepare for a growing family by giving them a taste of what it would be like to have children. This study also looks into the psychological well-being and life experiences of LGBT fur parents. Employing the Interpretative Phenomenological Analysis, the findings of this study were: (1) With the presence of fur babies, participants had the ease to overcome stressful events, especially the ones that affect their (...) mental health. With these, they have the desire to take care of their fur babies under all circumstances because they see their fur babies as family members. Fur babies are excellent sources of motivation, confidence, and happiness for fur parents. They are treated as family members because they contribute to the mental and emotional aspects of fur parents. Moreover, the majority of respondents valued their pets far more than their actual family members, however, some didn't spend as much time with their relatives and friends. This study comes to the conclusion that a stronger bond with one's dog was also linked to higher anxiety about being unloved and rejected by family members and people surrounding us, which was linked to a heavier impact on one's psychological well-being. In reality, fur parents, especially LGBT parents, offer their fur babies a lot of love and attention compared to other things. (shrink)

Due to the emergence of ICT in ELT sector, seasoned English teachers find it resistant to such a shift despite having a positive attitude towards its use. This quasi-experimental study aimed to examine the extent to which seasoned English language teachers developed their ICT skills through a Service-Learning Activity (SLA). Using a one-group pre- and post-test design, this study collected the data through a modified Needs Assessment Survey (NAS) distributed to fourteen purposively selected participants. It was administered to examine what (...) professional ICT development would greatly benefit them. The data were analyzed using descriptive statistics and themes according to the Service-Learning Activity (SLA) topics. A Post Evaluation Survey (PES) was administered, and its result was compared to the initial test. The results showed that the seasoned teachers gained significant learning gains in terms of (1) sharing of knowledge from other teachers; (2) being encouraged to use ICT tools; (3) training opportunities; (4) working with other colleagues; and 5) attending professional workshops which include SLA. This paper puts forward three critiques of pardo’s second-order proof rules thesis. The first criticism states that these rules are not suitable to guide the interpretation of standards of proof rules because they confuse matters of legal interpretation with matters of epistemology. The second criticism states that second-order proof rules are affected by the same indeterminacy problems they are designed to resolve, thereby rendering them unsuitable for the task they are purposely designed for. The counter majoritarian difficulty is one of the main objections against the judicial review. In this paper, this objection is analyzed from the standpoint of the norm formulation/norm distinction. By stressing the distinc- tion between norm formulations and norms, I claim that when judicial review prevents the application of a norm to an individual case the counter majoritarian difficulty objection does not hold.

Transdisciplinary research knits together knowledge from diverse epistemic communities in addressing social-environmental challenges, such as biodiversity loss, climate crises, food insecurity, and public health. This paper reflects on the roles of philosophy of science in transdisciplinary research while focusing on Indigenous and other subaltern forms of knowledge. We offer a critical assessment of demarcationist approaches in philosophy of science and outline a constructive alternative of transdisciplinary philosophy of science. While a demarcationist focus obscures the complex relations between epistemic communities, transdisciplinary (...) philosophy of science provides resources for meeting epistemic and political challenges of collaborative knowledge production.
